1. About Us & Scope

These Terms of Service ("Terms") govern your access to and use of the website at https://swimmingrhodes.gr (the "Site"), operated by ΥΓΡΟΣ ΣΤΙΒΟΣ ΡΟΔΟΥ ("Swimming Rhodes", "we", "us", "our"), a swimming club established in Rhodes, Greece.

The Site provides three main services:

• Club Promotion — information about our programs, schedules, facilities, and coaching team.
• eShop — online sale of swimming equipment, apparel, and accessories.
• Promotional Content — access to paid or members-only educational materials such as training seminars and instructional videos.

By accessing the Site or creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility & Accounts

Age requirement: You must be at least 18 years of age to create an account on this Site. We do not knowingly collect account credentials from individuals under 18. By registering, you represent and warrant that you are 18 or older.

Account responsibility: You are solely responsible for all activity that occurs under your account. You agree to:

• Keep your authentication details (magic link emails) confidential.
• Notify us immediately at info@swimmingrhodes.gr if you suspect unauthorised access to your account.
• Provide accurate and up-to-date information when required.

We reserve the right to suspend or terminate accounts that are used in violation of these Terms.

3. Club Promotion Content

The informational content on the Site — including program descriptions, schedules, coach profiles, and news — is provided for general informational purposes only. We endeavour to keep this information accurate and up to date, but we make no warranty as to its completeness or currency.

Program enrolment, physical lesson bookings, and in-person memberships are governed by separate agreements entered into directly with Swimming Rhodes at our facilities. These Terms do not create any contractual right to participate in our swimming programs.

4. eShop — Purchases

4.1 Ordering

When you place an order through our eShop, you are making a binding offer to purchase the selected item(s). A contract of sale is formed when we send you an order confirmation email.

4.2 Prices & VAT

All prices are displayed in Euros (€) and include Greek VAT (ΦΠΑ) at the applicable rate. We reserve the right to correct pricing errors at any time before dispatch; in the event of an error we will contact you to confirm or cancel the order.

4.3 Payment

Payments are processed securely through Stripe. We do not store or handle your payment card details directly. By completing a purchase you agree to Stripe's Terms of Service.

4.4 Delivery

Physical goods are delivered to the address you provide at checkout. We are not responsible for delays caused by carriers or incorrect addresses supplied by the customer. Delivery costs and estimated timeframes are displayed at checkout.

4.5 Returns & Right of Withdrawal

In accordance with Greek consumer protection law (Law 2251/1994, as amended) and EU Directive 2011/83/EU, consumers have the right to withdraw from a distance purchase within 14 calendar days from the day of receipt of physical goods, without giving any reason. To exercise this right, contact us at info@swimmingrhodes.gr before the 14-day period expires.

The right of withdrawal does not apply to:

• Digital content or Promotional Content that you have started accessing after giving explicit consent that you lose your right of withdrawal (confirmed at checkout).
• Goods that have been personalised or are non-returnable for hygiene reasons (e.g., opened swimwear or goggles).

Returned goods must be in their original, unused condition. We will refund the purchase price within 14 days of receiving the returned item.

5. Promotional Content & Digital Access

Certain content on the Site (seminars, training videos, instructional materials) may require a paid purchase or a registered account to access ("Promotional Content").

• Licence: Upon purchase, we grant you a personal, non-transferable, non-sublicensable licence to access and view the Promotional Content for your own private, non-commercial use.
• No redistribution: You may not share, copy, record, reproduce, sell, or publicly display any Promotional Content without our prior written consent.
• Access period: Unless otherwise stated at the point of purchase, access to Promotional Content is granted for as long as your account remains active.
• Refunds for digital content: By proceeding with a purchase of digital content and confirming you wish to access it immediately, you explicitly waive your 14-day right of withdrawal. All sales of digital content are final unless the content is materially defective.

6. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to any part of the Site or our backend systems.
• Transmit any malicious code, spam, or content that is offensive, defamatory, or infringes third-party rights.
• Scrape, data-mine, or systematically extract content from the Site without our written consent.
• Share your account credentials with any other person or allow any other person to access the Site through your account.

7. Intellectual Property

All content on the Site — including but not limited to text, photographs, logos, graphics, videos, and training materials — is owned by or licensed to ΥΓΡΟΣ ΣΤΙΒΟΣ ΡΟΔΟΥ and is protected by Greek and EU copyright law.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand features. Unauthorised use of our intellectual property may result in civil or criminal liability.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by Greek law. We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable Greek law, ΥΓΡΟΣ ΣΤΙΒΟΣ ΡΟΔΟΥ shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under Greek law.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Greece. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Rhodes, Greece.

If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence. The European Commission also provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or applicable law. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.
